Comrade Brown Osemwengie Condemns Tinubu’s Suspension of Gov Fubara.

An International Human Right Campaigner of Edo origin, Comrade Brown Ehigie Arisco Osewengie, the global president of Edo Dynasty United Organization Worldwide has condemned in totality, the recent suspension of Rivers State governor, deputy and house of assembly members as completely illegal, against the rule of law and the constitution of the Federal Republic of Nigeria.

In a statement made available to Urban Scoop Media from Ontario Canada, the international human right activist stated as follows “The recent declaration of a state of emergency in Rivers State by President Bola Ahmed Tinubu, resulting in the suspension of Governor Siminalayi Fubara, his deputy, and all elected members of the House of Assembly, raises significant constitutional and ethical concerns. 

Unconstitutionality of the State of Emergency Declaration

The Nigerian Constitution permits the declaration of a state of emergency under specific circumstances to maintain law and order. However, the suspension of duly elected officials during such a declaration is unprecedented and lacks constitutional backing. The Nigerian Bar Association has criticized this move as illegal, emphasizing that an emergency declaration does not automatically dissolve or suspend elected state governments. 

Political Underpinnings and Minister Nyesom Wike’s Involvement

The political crisis in Rivers State has been exacerbated by tensions between Governor Fubara and factions within the state’s political landscape, notably those aligned with his predecessor, Nyesom Wike, now the Minister of the Federal Capital Territory. Allegations suggest that Wike has been involved in instigating the crisis, with reports indicating his refusal to engage in peace efforts to resolve the conflict.  Despite these allegations, there has been no public admonishment or corrective action from President Tinubu towards Minister Wike, raising questions about impartiality and the equitable application of justice.

Implications for Democratic Governance

The suspension of elected officials undermines the principles of democratic governance and sets a concerning precedent for federal overreach into state affairs. Such actions can erode public trust in democratic institutions and processes, leading to increased political instability.

Call for Adherence to Constitutional Provisions

It is imperative that any actions taken to address crises within a state adhere strictly to constitutional provisions. The federal government should respect the autonomy of state governments and ensure that interventions do not violate democratic principles or the rule of law.

Conclusion

The declaration of a state of emergency in Rivers State, coupled with the suspension of its elected officials, appears to be an unconstitutional measure that threatens the fabric of Nigeria’s democracy. Furthermore, the lack of accountability for individuals allegedly instigating the crisis, such as Minister Nyesom Wike, calls into question the fairness and integrity of the federal government’s actions. It is crucial for the preservation of democracy that all government actions be conducted within the bounds of the constitution and that all individuals, regardless of position, be held accountable for actions that destabilize governance”.
